What is a transparency report?

Global laws create obligations on organizations to provide data to public authorities, including government agencies, for civil, administrative, criminal, and national security purposes.

As such Tangoe may be legally required to disclose data upon receipt of a legally valid request.

Whilst Tangoe has never, to date, had a public authority request for access to its data, we are aware how important statistics and information on this subject is to our clients, and so have published a transparency report.

A transparency report is where organizations share information about the number and type of data requests they have received from global government agencies.

How would Tangoe handle a government request for customer information?

Tangoe has never, to date, had a public authority request for access to its customers’ data, however, we have a documented policy on how we would respond in event of a request being made. The applicable Tangoe teams have been trained on the policy to ensure awareness and compliance.

In event of receipt of a request, Tangoe’s initial response would always be to redirect the government organization to make the request directly to the applicable customer and, where not prohibited by law, to notify our customer of the request.

Where customer notification is not feasible for the request purposes, Tangoe would take care to follow its third-party data request policy and document the steps taken.

Every request will be carefully reviewed by the Tangoe legal team to determine its validity, proportionality, and lawfulness, and to understand international data protection commitments applicable to the data. 

Tangoe understands the need to balance respect for the seriousness of law enforcement investigations, with its customers’ rights to due process and transparency.

Tangoe will challenge the request and endeavour to prevent data disclosure, if after careful assessment we conclude that it is lawful to do so.  Where applicable, we will inform the requesting public authority of the incompatibility of the request with safeguards contained in the GDPR Article 46 transfer tool and will not disclose data until required to do so.

Where, despite efforts to prevent the disclosure, Tangoe is obligated to disclose data to a public authority, we shall redact unnecessary information and ensure that the data is minimised to the greatest extent possible.
